Milton Plans Stiff Rules For Any Pawn Shop

The City Council reviews the need for additional regulations on pawn shops before any open in the city.

Milton City Council members decided they want stiffer requirements for pawn shops in place before any pawn shops open for business in the city.

Paul Frickey of the Jarrard & Davis law firm gave a presentation before City Council Monday night regarding possible restrictions for pawn shops that may choose to open their doors in Milton.

While there is legislation put in place by the federal government, local government may provide additional legislation and regulations.

Federal guidelines require establishments to disclose all fees charged to an individual as well as a limit to interest that can be charged. They also insist shops maintain a permanent record book with the name, age, address and description of the general appearance of the customer.

Other requirements include the customer having to provide a driver's license or other photo identification as well as the identification and description of the pledged or purchased good including serial numbers if available.

Despite these federal requirement, many cities demand additional measures before a pawn shop is allowed to operate in their jurisdiction. While there are no pawn shops in Milton, council members think it’s safe to be prepared.

Several surrounding cities that have such measures in place were studied for guidance, including Roswell, Johns Creek and Douglasville.

Desirable measures for consideration include providing an actual photograph of the customer, prohibiting transactions with minors and not accepting unopened items that are not accompanied with a receipt.

All additional measures are in hopes of further deterring and reducing theft in and around the area.

“This is really tied to public safety and public welfare not at all to limit business but to ensure that we’re protecting our citizens,” said Councilwoman Julie Zahner Bailey.

After further discussion from council members it was agree upon that additional requirements were desired in the event of a pawn shop opening in Milton.

Businesses offering money for gold will also be subjected to additional requirements when considering which additional laws to adopt.
