Greater North Fulton Chamber of Commerce President & CEO Brandon Beach violated state law when he did not refund contributions raised for the 2010 primary election, according to Atlanta Unfiltered.

Beach, running for the Georgia Senate at the time, raised $13,600 he planned to spend during the general election, but lost the primary. 

The investigative journalism website notes the state requires candidates to give back contributions raised during an election period in which they are not on the ballot.

The Alpharetta resident kept those contributions and also applied them to his 2012 primary challenge against former Senator Chip Rogers, the website notes. 

Beach told Atlanta Unfiltered that he didn't know the contributions had to be refunded, calling his mistake "unintentional" and that he plans to correct his actions. 

Beach is facing a contentious race in Tuesday's special election for the Georgia Senate District 21 seat against former State Rep. Sean Jerguson.

Jerguson resigned the House District 21 seat he won in November to run for the senate seat, which was vacated by Rogers in December when he resigned to take a position with Georgia Public Broadcasting. 

Atlanta Unfiltered's article is one of two written about both candidates for the race.

The website published a piece on Jerguson failing to list in financial disclosures property owned by businesses he lists as having ownership interests and how one business, Sapphire Pointe, is being sued in federal court for not making payments on a loan.

Jerguson is a party in the case as he is a passive investor in the company.
